As we've told you previously on Elsewhere, three men have been accused of stealing and trying to resell a collection of lyrics to the Eagles hit "Hotel California" But they are finding out they can check out AND they can also leave. Prosecutors are dropping all charges, including criminal possession and conspiracy, against Glenn Horowitz, Edward Kosinski and former Rock and Roll Hall of Fame curator Craig Inciardi. The decision came after Eagles co-founder and key witness Don Henley waived attorney-client privilege and submitted six-thousand pages of related correspondence with his attorneys just a few days ago. Prosecutors and the judge agreed the defense was not provided "the opportunity to explore" the new evidence. The handwritten lyrics from the Eagles' 1976 smash album were valued at more than one-million dollars An attorney for Don Henley said he plans to take civil action.
