The prostitution case against New England Patriots owner Robert Kraft is before a Florida appeals court.
Prosecutors are trying to convince the Fourth District Court of Appeal to allow in trial video from hidden cameras that police set up inside the Orchids of Asia Day Spa in Jupiter.
They say that shows Kraft engaging in sex acts at the massage parlor in January of 2019.
A judge threw out the video, claiming a warrant didn't sufficiently protect the privacy of innocent customers who received legal massages.
Kraft and two dozen other customers face misdemeanor charges while the spa owners and some employees face prostitution-related felonies.
The 79-year old billionaire has pleaded not guilty but issued a public apology.
